Zyflow Terms of Service

1. Who we are and what these Terms cover
Zyflow is operated by HERKO d.o.o., Pševska cesta 10, 4000 Kranj, Slovenia, registration number 8830045000, VAT ID SI56613555 ("we", "us"). Contact: legal@zyflow.eu.
These Terms of Service ("Terms") are the agreement between you and us for the use of the Zyflow mobile app for iOS and Android, the websites zyflow.eu, app.zyflow.eu and navigate.zyflow.eu, and related services (together the "Service"). Section 15 contains additional terms for business users of the partner portal.
By creating an account or using the Service you accept these Terms. If you do not agree, please do not use the Service.
How we process personal data is explained in our Privacy Policy: https://www.zyflow.eu/legal-pages/privacy-policy. The Privacy Policy is an information notice, not part of this contract.
2. The Service
Zyflow is a cycling app. It lets you plan, navigate, save, import and export cycling routes (including GPX files); estimate distance, time, elevation and, for e-bikes, battery range; discover places along the way (for example e-bike chargers, repair stations, water points, bike parking, shops, cafés and accommodation); see weather and traffic or road-condition alerts; keep a bike passport; and share selected routes, photos and place reports with the community.
The Service is currently free of charge. It is offered for users in the European Union and the European Economic Area.
We may develop, change or discontinue features. If a change significantly affects you negatively, we will inform you in advance and you may end the contract at any time by deleting your account (see section 13). Your statutory rights for digital services remain unaffected.
3. Who may use Zyflow: age 16+ and your account
3.1 You must be at least 16 years old to create an account and use the Service. By creating an account you confirm that you are at least 16 years old. If we learn that an account belongs to someone under 16, we will delete it.
3.2 You can register with your email address or with Sign in with Apple or Google. Please provide accurate information and keep it up to date.
3.3 Keep your login details confidential and tell us at legal@zyflow.eu if you suspect misuse of your account. You are responsible for activity in your account unless it was caused without your fault (for example by a security failure on our side).
3.4 One person, one account. Accounts are personal and may not be sold or transferred.
4. Licence to use the app
We grant you a personal, non-exclusive, non-transferable licence, revocable in accordance with these Terms, to install and use the app on devices you own or control and to use the Service for your own personal, non-commercial purposes. App store terms (Apple App Store, Google Play) also apply to the download.
You may export routes as GPX files and use them for your own navigation on any device or app. You may not sell or commercially distribute exported files or data from the Service without our written consent.
5. Routing, navigation and safety
Please read this carefully. Zyflow helps you plan rides, but you are always responsible for your own safety on the road.
5.1 Routes are suggestions. Routes, distances, times, elevation, surface and way-type information, difficulty ratings, e-bike battery range estimates, weather and traffic alerts are calculated automatically from map data, third-party sources and community input. They can be incomplete, outdated or wrong. A suggested route may include roads with heavy traffic, closed or private roads, steep or unpaved sections, or sections unsuitable for your bike, your skills or the weather.
5.2 Your responsibilities. You must always:
- follow traffic rules and road signs, which take precedence over any route instruction in the app;
- check whether a route is safe, legal and suitable for you, your bike and the conditions, and change or stop your ride if it is not;
- pay attention to traffic, road conditions, weather and other road users;
- not operate your phone in a way that distracts you while riding; mount it securely or stop before using it;
- use suitable equipment (lights, brakes, helmet where required or recommended) and keep your bike roadworthy;
- plan enough reserve for your battery, water, food and daylight, and do not rely on the app as your only means of navigation or communication.
5.3 No guarantee of road conditions. We do not inspect roads or paths and cannot guarantee their condition, safety, accessibility or legal status, or that traffic and road-condition alerts are complete or current.
5.4 Places and chargers. Information about places (for example whether a charger, water point, repair station, shelter or shop exists, is open, works or is free to use, its opening hours or capacity) comes from OpenStreetMap, partners and other users. We do not guarantee its accuracy, availability or timeliness. Check important information yourself, especially before relying on a charger or water point.
5.5 Emergencies. Emergency numbers shown in the app are provided for convenience. In an emergency call 112. The app is not an emergency service.
5.6 Our liability for damage is governed by section 12; nothing in this section excludes liability that cannot be excluded by law.
6. Community routes (optional)
6.1 Sharing is opt-in. Your saved routes are private. You can choose to share an individual route with the community. Nothing is shared automatically.
6.2 What becomes visible. A shared route shows the full GPS track including the start and end points, its name, your description, region, difficulty, distance, duration, elevation and surface details, an automatically generated map image and any photos and captions you add. All signed-in users can see shared routes, save copies of them to their own account and share links to them. Photos and map images are stored in publicly accessible storage and can be opened by anyone who has the link.
Protect your home address. The start and end points of a route can reveal where you live, work or keep your bike. Before sharing, consider starting and ending the route away from your home, and do not upload photos showing people without their permission, house numbers, licence plates or other personal details.
6.3 Licence you grant us. You keep all rights to the routes, descriptions, photos and other content you share ("your content"). By sharing, you grant us a non-exclusive, royalty-free, worldwide licence, for as long as your content is shared, to host, store, reproduce, adapt technically (for example resize photos, generate map images and route statistics), display and make your content available to users within the Service and in links shared from it, as far as needed to operate, show and promote the community features of the Service. You also allow other users to view your shared route, save a copy and use it for their own personal, non-commercial riding.
6.4 Removal. You can remove a shared route or photo at any time. Our licence then ends, except that (a) copies that other users have already saved remain in their accounts, (b) residual copies may remain in backups for up to 7 days, and (c) we may keep content as required by law or to defend legal claims.
6.5 Your responsibility. You are responsible for your content. You confirm that you have the necessary rights to it (for example to photos and to imported GPX tracks), that people recognisable in photos have agreed, and that it does not break the law or these Terms (section 9).
7. Place reports and submissions
7.1 You can report whether a place exists or works, add notes and photos, and suggest missing or incorrect places. Please report honestly and from your own experience, and do not include personal data in notes.
7.2 Place reports are shown to other users as community signals without your name. Suggestions for new or corrected places are reviewed by our team; we decide whether and how to use them.
7.3 By submitting a report or suggestion you grant us a non-exclusive, royalty-free, worldwide, perpetual and irrevocable licence to use, adapt, combine and publish the factual information (location, attributes, status) in our places database, including after you delete your account (then without any link to you). Notes and photos you add are covered by the licence in section 6.3 and are deleted with your account.
8. Bike passport
The bike passport lets you store information about your bikes (for example make, model, frame number, purchase date and value, photos) and create a bike passport document on your device. It is private to you. It is a personal record only: it is not an official register, proof of ownership or insurance document, and we do not guarantee that it will be accepted by police, insurers or others. Keep your own copies of important documents.
9. Acceptable use and content rules
You must not:
- upload or share content that is illegal, infringes the rights of others (copyright, privacy, personality rights), is defamatory, hateful, violent, sexually explicit, harassing or discriminatory;
- share personal data of other people, including photos of identifiable people without their consent;
- share routes that lead through private property without permission, prohibited or protected areas, or that encourage dangerous or illegal riding;
- submit false, misleading or manipulative reports or reviews, including reviews of your own business or a competitor;
- use the Service for advertising or spam, or impersonate other people or organisations;
- scrape, harvest or bulk-download data, access our APIs other than through our apps, or circumvent rate limits or security measures;
- reverse engineer the app, except where the law allows this;
- interfere with, overload or attack the Service, or upload malware.
10. Reporting content and moderation
10.1 You can report photos in the app ("Report photo"). To report anything else, for example a shared route, a description or a place, or to tell us about content you believe is illegal or breaks these Terms, write to legal@zyflow.eu. Please explain why, where the content is, and give your name and email (except for reports of child sexual abuse material). This email address is also our single point of contact for users and authorities under the EU Digital Services Act.
10.2 We review reports diligently and may hide or remove content, limit features or suspend accounts. Photos that have been reported by several users may be hidden automatically until we review them.
10.3 When we remove or restrict your content or account, we will inform you of the reasons, unless the law prevents this or the content is spam. You can contest our decision by writing to legal@zyflow.eu; we will review it again and reply. You may also use out-of-court dispute settlement bodies or the courts.
10.4 We do not check content before it is published and are not obliged to monitor it in general.
11. Third-party services, data and affiliate links
11.1 The Service uses data and services from third parties, including OpenStreetMap (© OpenStreetMap contributors, Open Database License), MapTiler, Photon (komoot), Nominatim, GraphHopper, Open-Meteo, DeepL, public traffic-information providers and partners. Some featured routes are provided by third parties and are marked as such. Attributions are shown in the app.
11.2 Accommodation links (Stay22). For some places the app shows a booking link from our affiliate partner Stay22. Links to Stay22 may be affiliate links: if you book through them, we may receive a commission, at no extra cost to you. The booking contract is concluded only between you and the accommodation or booking provider, under their terms. We are not a party to it and are not responsible for prices, availability or performance.
11.3 Links to and services of third parties (including Sign in with Apple or Google and app stores) are subject to their own terms and privacy policies. Mentioning a place, business or provider is not an endorsement.
12. Liability
12.1 The Service is free and provided with reasonable care, but we cannot guarantee that it is always available, error-free or that the data in it is complete and accurate (see sections 5 and 11). Your statutory rights as a consumer, including rights in case a digital service is not in conformity with the contract, remain unaffected.
12.2 We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health caused by our fault, and where liability cannot be excluded or limited under mandatory law (including product liability rules).
12.3 Outside the cases in section 12.2, we are liable according to the general rules of law. Nothing in these Terms limits or excludes the mandatory rights of consumers. A limitation of liability for slight negligence applies only to business users (section 15.4).
12.4 We are not responsible for damage to the extent it is caused by your failure to follow section 5.2, by the actions of other users, or by third-party data, services or booking providers for which we are not responsible under the law. This does not apply where we are liable under section 12.2 or under mandatory law.
12.5 If you are a consumer, you are liable to us only for damage you cause culpably by breaching these Terms, according to the general rules of law.
13. Ending the contract: suspension and deletion
13.1 By you. You can end the contract at any time by deleting your account in the app (Profile tab → gear icon (Settings) → Delete account), on the web at https://www.zyflow.eu/legal-pages/delete-account or by email to legal@zyflow.eu. What happens to your data is explained in the Privacy Policy.
13.2 By us. We may end the contract for any reason with at least 30 days' notice by email or in the app, for example if we discontinue the Service.
13.3 Suspension or termination for cause. We may suspend features, remove content or suspend or close an account, where appropriate after a warning, if you seriously or repeatedly break these Terms or the law, provide false information, endanger other users or the Service, or if we are legally required to. We will act proportionately, give reasons (section 10.3) and you may contest the decision. Accounts of users under 16 are deleted.
13.4 After termination, sections 6.4, 7.3, 12 and 16 continue to apply.
14. Intellectual property
The app, software, design, the Zyflow name and logo, our own texts, curated content and our places database are protected and belong to us or our licensors. Apart from the licence in section 4, these Terms give you no rights to them. Map data from OpenStreetMap is subject to the Open Database License. If you send us feedback or ideas, we may use them freely without payment; this does not transfer any personal data rights.
15. Partner portal (business users)
15.1 Businesses (for example accommodation, restaurants, cafés, charger operators) can request access to the Zyflow partner portal to claim their place and manage its details. Partner access is granted at our discretion after review. If we introduce fees for partners, we will inform you in advance and they will apply only if you agree.
15.2 The person requesting access confirms that they are authorised to act for the business. Partners must keep their information accurate and lawful, may only edit places they are entitled to represent, and are responsible for the content they publish (including prices, opening hours and offers) and for complying with consumer and advertising law.
15.3 Partners grant us the licence in section 6.3 for content they publish through the portal, for as long as the place is listed. We may edit, reject or remove partner content that is inaccurate or breaks these Terms, and may revoke partner access with reasons.
15.4 For business users, consumer protection rules do not apply. To the extent permitted by law, our liability towards business users for slight negligence is excluded and in any case limited to EUR 500 or the amount the business user paid us in the 12 months before the event giving rise to the claim, whichever is higher; section 12.2 still applies.
16. Changes to these Terms
We may change these Terms if there is a valid reason, for example new features, changes in law or court decisions, or security needs. We will inform you of material changes by email and/or in the app at least 30 days before they take effect and explain what changes. If you do not agree, you may delete your account before the changes take effect. If you continue to use the Service after that date, the new Terms apply. Changes that are solely to your benefit, or required by law with a shorter deadline, may apply sooner.
17. Governing law, disputes and consumer rights
17.1 These Terms are governed by the law of the Republic of Slovenia, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in another EU/EEA country, you also keep the protection of the mandatory consumer law of your country of residence.
17.2 If you are a consumer, you may bring proceedings in the courts of Slovenia or of the EU country where you live; we may sue you only in the courts of your country of residence. For business users, the courts in Kranj, Slovenia have jurisdiction.
17.3 We will try to resolve complaints amicably: please write to legal@zyflow.eu; we will reply within 8 days and aim to resolve your complaint within 30 days.
17.4 Out-of-court dispute resolution. We do not recognise any provider of out-of-court consumer dispute resolution as competent. Any dispute with us may be brought before the competent court in Kranj, without limiting the mandatory right of consumers to bring proceedings at their place of residence (section 17.2).
18. Final provisions
18.1 If a provision of these Terms is invalid, the rest remains valid; the invalid provision is replaced by the statutory rules.
18.2 We may transfer this contract to a company that takes over the Service, provided your rights are not reduced; we will inform you in advance and you may delete your account. You may not transfer your rights without our consent.
18.3 These Terms are available in English and Slovenian. Both versions are equally valid; for consumers in Slovenia the Slovenian version prevails in case of discrepancy.
18.4 We are not responsible for delays or failures caused by events outside our reasonable control (for example natural disasters, outages of networks or third-party providers), as far as permitted by law.
